1. Acceptance
By creating a Streamsynq account or by clicking "I agree" during sign-up, you agree to these Terms of Service ("Terms"). If you are agreeing on behalf of a brokerage or business entity, you represent that you have authority to bind that entity.
2. Eligibility
Streamsynq is licensed only to actively licensed real estate professionals or their employer brokerage in the United States. You represent that your real estate license is current and in good standing in the state(s) where you operate.
3. Subscription and billing
Plans and pricing
Streamsynq is sold via tiered monthly subscription plans. Current pricing is published at streamsynq.io/pricing.
Founding tier
The first ten (10) customers to subscribe to the Founding plan are entitled to retain that pricing ($249/month) for the lifetime of their continuous subscription, unless they downgrade or cancel. Once the cohort is full, Founding pricing is no longer available to new customers.
Auto-renewal
Subscriptions automatically renew monthly. You may cancel at any time through Settings → Plan & Billing. Cancellation takes effect at the end of your current billing period; you retain access through that date and are not charged again.
Refunds
Subscription fees are non-refundable except where required by law. We offer a 30-day money-back guarantee for new customers — if you cancel within 30 days of your first paid invoice and have not produced any AI calls, we will refund the most recent monthly charge. Failed payments
If a payment fails, Stripe will automatically retry. After 14 days of unpaid status, your account is suspended. After 60 days, your account and data are permanently deleted unless you reactivate.
4. Your obligations
Lead consent (TCPA)
You represent and warrant that every lead you send to Streamsynq — whether through a connected CRM, lead source webhook, manual entry, or otherwise — has provided prior express written consent as defined under the Telephone Consumer Protection Act (47 U.S.C. § 227) for you and your authorized agents (including AI tools acting on your behalf) to contact them by automated voice call and SMS for the purpose of real estate inquiries.
You acknowledge that Streamsynq cannot verify consent on a per-lead basis and that you are solely responsible for any TCPA violations arising from leads you submit without proper consent.
Fair housing compliance
You will not configure or use Streamsynq in any manner that discriminates against protected classes under the federal Fair Housing Act (42 U.S.C. §§ 3601–3631) or any applicable state or local fair housing law. This includes prohibiting AI prompts that screen leads based on race, color, national origin, religion, sex, familial status, disability, or any other protected category.
Real estate license compliance
You are responsible for complying with all real estate licensing rules in your jurisdiction, including but not limited to disclosure obligations, agency representation rules, and supervision requirements. Streamsynq is software — it is not a licensed real estate professional and does not replace your regulatory obligations.
Acceptable use
- You will not use Streamsynq to send unsolicited messages, spam, or commercial content unrelated to real estate inquiries
- You will not impersonate another person or entity
- You will not attempt to reverse-engineer, scrape, or extract data from Streamsynq beyond your own customer data
- You will not use Streamsynq to send communications to consumers in jurisdictions where you are not licensed to provide real estate services
5. Our obligations
- Maintain reasonable uptime (target 99.5% monthly, excluding scheduled maintenance and force majeure)
- Keep your data encrypted in transit and at rest
- Apply security patches in a reasonable timeframe
- Provide email support to all paid customers; SMS support and dedicated success rep for higher tiers
- Notify you of any data breach affecting your account within 72 hours of discovery
6. Third-party services
Streamsynq integrates with third-party services (Stripe, Twilio, Retell AI, Anthropic, Repliers, Supabase, Vercel, Resend, and CRMs you connect). These services have their own terms of service that apply alongside these Terms. We are not responsible for outages, errors, or data losses caused by third-party services.
When you connect a third-party CRM (e.g. Follow Up Boss, kvCORE) by providing API credentials, you authorize Streamsynq to access and modify data in that CRM on your behalf as needed to deliver the Streamsynq service.
7. Intellectual property
Streamsynq retains all intellectual property rights in the software, design, and brand. You retain all rights to your data and content. By using Streamsynq, you grant us a limited, non-exclusive license to process your data solely to provide the service.
We may use anonymized, aggregated usage data (e.g., "X% of Streamsynq customers use feature Y") for product improvement and marketing. This data cannot be linked back to you or your leads.
8. Indemnification
You agree to indemnify and hold Streamsynq harmless from any claim, demand, loss, or expense arising from: (a) leads you submitted without proper consent under TCPA, (b) communications sent to leads in jurisdictions where you are not licensed, (c) fair housing violations resulting from your configuration or use of the platform, (d) your breach of these Terms, or (e) your real estate licensing violations.
9. Limitation of liability
To the maximum extent permitted by law, Streamsynq's total liability arising out of or relating to these Terms or your use of the service shall not exceed the total fees you paid to us in the twelve (12) months preceding the claim.
Streamsynq is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated. AI-generated content (call transcripts, SMS replies, content posts) may contain errors — you are responsible for reviewing it before relying on it in regulated contexts.
10. Suspension and termination
We may suspend or terminate your account if you:
- Materially breach these Terms
- Fail to pay fees
- Use the platform for illegal purposes or in a manner that creates carrier or compliance risk for other Streamsynq customers
- Trigger repeated TCPA, fair housing, or carrier-spam complaints
You may terminate your account at any time. On termination, we will retain your data for 90 days to allow recovery, then permanently delete it.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved in the state or federal courts located in Hillsborough County, Florida.
12. Changes
We may revise these Terms from time to time. Material changes will be communicated to active customers via email at least 30 days before taking effect. Your continued use of Streamsynq after the effective date constitutes acceptance of the revised Terms.
